Korea`s Position Regarding Japan's Countervailing Duty on Hynix D-ram

ㅇ On January 20, 2006, the Japanese government reported to Korea its final determination to impose a 
countervailing duty on Hynix D-ram made in Korea for a duration of 5 years starting from January 27, 2006.

 

※ An investigation was conducted from August 2004 by the request of  Elpida Memory and Micron Japan 
on June 16, 2004.

 


ㅇ The Korea government, after concluding that Japan’s measure is unreasonable and intended to protect 
its domestic industry, brought a lawsuit against Japan for its countervailing duty measures.

 

※ Both sides agreed to select the members of a panel in August 2006 and the WTO panel is proceeded.

 


ㅇ Hynix’s recent profit has proved that the creditor banks' decision in 2001 for debt restructuring was 
reasonable and made on commercial basis. In this context, Japan’s imposition on countervailing duty is 
lacking objective rationality.
